Chief Justice of Nigeria, Mahmud Mohammed bows out on Thursday

10 November 2016, 10:28Lekan Oladeinde

Abuja - The Chief Justice of Nigeria, Justice Mahmud Mohammed, will on Thursday retire from service.

Mohammed turns 70 on Thursday, the mandatory retirement age for justices of the Court of Appeal and the Supreme Court.

Unfortunately, a successor is yet to be appointed by President Muhammadu Buhari, whose duty it is to appoint a CJN based on the recommendations of National Judicial Council (NJC).

By virtue of Section 231 of the 1999 Constitution, it is the prerogative of the President to appoint a CJN.

The NJC during an emergency meeting held on October 11, 2016 had recommended Justice Walter Samuel Onnoghen for consideration as the new CJN.

The President is yet to accept the recommendation of the NJC.

In law, the President is not bound to accept Onnoghen's nomination.

He, however, cannot bypass the council in making the appointment.

With the President yet to accept the NJC's recommendation on the new CJN, it is not clear who will be appointed as acting CJN.
