Lagos - Former President of the Nigerian Bar Association (NBA), Dr. Olisa Agbakoba (SAN) has stated that the current Abia State Governor, Okezie Ikpeazu should vacate the office immediately, Thisday reports.
Agbakoba said in the eyes of the law, Ikpeazu has been removed by the court and he is no longer the governor of Abia State.
He stated that court has removed him as governor but the problem is that there’s a transition period. But the court has removed him as governor and there’s a new governor-elect who is yet to be sworn-in.
He further stated that the "Notice of Appeal" presented by Ikpeazu is clearly not a Stay and INEC has broken no law in issuing Certificate of Return to Uche Ogah.
News24 previously reported that Justice Okon Abang of the Federal High Court, Abuja ordered the removal of Governor Okezie Ikpeazu and ordered INEC to issue a Certificate of Return to Ogah, who was the first runner-up in the state governorship primary of the Peoples Democratic Party.
Justice Abang had ordered the removal of Ikpeazu after finding him guilty of not presenting relevant tax certificates along with his forms submitted to INEC.
He held that Ikpeazu, who emerged as the candidate of the PDP in the state for the 2015 governorship election on the strength of the primary, was not qualified to be the candidate of the PDP.
