No more environmental sanitation in Lagos -Court of Appeal

Lagos - The Court of Appeal sitting in Lagos has ordered the state government to stop restricting the movements of people during environmental sanitation exercises held every last Saturday of the month.

The court according to PM News described the sanitation as illegal and banned the government from further restricting anyone’s movement between 7 am and 10 am when the exercise holds.

The court said there was no written law to the effect that residents must stay at home during these periods.

Justice Ugochukwu Ogakwu of the Court of Appeal, Lagos Division ordered that because of the absence of any written law, the directive of the governor on restriction of movement is unlawful, illegal and unconstitutional.

According to the appellate court, the Lagos state government and its affiliates do not have the right to arrest anyone on the basis of a purported environmental sanitation offence.

The suit was brought before the court by a citizen, Faith Okafor (Appellant) against the Lagos State Government (Respondent).
