Appeal Court affirms Edo APC lawmaker’ elections

Benin- City - Members of the All Progressives Congress (APC) in Edo State were in jubilant mood on Thursday as the Appeal Court sitting in Benin, ruled in favour of their candidate.

The Court upheld the judgement of the lower tribunal, which declared APC’s candidate, Patrick Aisowiere, winner of the House of Representatives’ election for Orhiomwon/ Uhumwonde federal constituency.

Justice Barka in his verdict stated that the failure of the Peoples Democratic Party (PDP) to sign their column in the petition indicated that only the candidate signed the entire petition, which is against section 4 (2) of first schedule of the Electoral Act, 2010 as amended.

It will be recalled that the National Assembly Election Petition Tribunal in the state had earlier ruled in favour of the APC candidate, whose election was being challenged by the PDP candidate, Larry Ogieva.

The tribunal in its ruling dismissed Ogieva’s petition on the ground that the PDP failed to sign its column in the petition filed by Ogieva.

The PDP and Ogieva had approached the Appeal Court to upturn the verdict in their favour.
