Yola - The Congress for Progressive Change (CPC) in Adamawa said on Wednesday it had appealled against the ruling of the state Election Petition Tribunal which struck out the party's petition .The News Agency of Nigeria (NAN) reports that the tribunal on Feb. 6, struck out CPC's petition challenging the Nov. 24, 2012 council polls because the petition was filed out of time. The tribunal ruled that the 60 days provided by the Adamawa State Electoral Law 2002 for entertaining such petition had lapsed.The tribunal also noted that the party did not forward any request for extension of time on its petition as required by law.But CPC counsel, Mr Sunday Joshua, told newsmen shortly after filing the notice of appeal at the Local Government Election Petition Appeal Tribunal in Yola, that the step was based on three grounds.He said the grounds included the shutting out of CPC counsel by the lower tribunal, a development that allegedly denied him the opportunity to file or move the necessary motion for extension of time for the petition to be heard. “We are praying for an order that a new panel be constituted for the petition to be heard on its merit."We are here for justice and we believe justice will be done by the appeal tribunal, " Joshua said.The CPC had dragged the state Independent Electoral Commission, all the 21 local government chairmen and their deputies elected on the platform of PDP before the tribunal, alleging that they were not qualified to contest the election.The CPC also contended that the election did not comply with the state electoral law.NAN
