Appeal Court upholds Osun APC Senator’s election

03 December 2015, 20:21

Akure - The Court of Appeal sitting in Akure, the Ondo State capital  on Wednesday struck out the petition filed by the candidate of the Peoples Democratic Party (PDP) in the Osun East Senatorial district election, Francis Adenigba Fadahunsi, against the election of  Babajide Omoworare, reports The Nation

Fadahunsi had approached the court to challenge the ruling of the election petition tribunal sitting in Osogbo, the Osun state capital which upheld the victory of Omoworare of All Progressives Congress (APC).

He had also prayed the appeal court for the nullification of the election of Omoworare on the ground of non compliance and manipulation.

The court said the appellant could not prove the allegation of manipulation, shooting and scaring away of voters and electoral officers.

In his ruling, Justice Abiriyi Shehu held that the PDP candidate could not prove its case beyond reasonable doubt and therefore dismissed the entire case and upheld the ruling of the tribunal.
