Court dismisses Bayelsa Speaker’s case against removal

Port Harcourt - The Court of Appeal sitting in Port Harcourt, Rivers State has dismissed the case instituted by former Speaker of the Bayelsa State House of Assembly, Kombowei Benson against the judgment that removed him from office, reports Leadership.

Benson was removed from office on December 9, 2015 following the ruling of the same court, which nullified his election victory.

The court in its ruling on Monday affirmed the earlier judgement of the court.

Justice Abdu Aboki, who delivered the ruling on Benson’s application, said though the controversy over the December 9, ruling by the five justices was triggered by an error in records by his lordship Justice Mohammed Garba, the error does not invalidate the ruling of the court on the nullity of his election. 

Benson had insisted that the ruling of the court did not sack him as a member of the Bayelsa State House of Assembly.
