Court upholds Ondo PDP candidate election

Akure - The Appeal Court in Akure has dismissed the judgment delivered by the Election Petitions Tribunal in Ondo State, which nullified the election of Kolade Akinjo representing Ilaje|Ese Odo Federal Constituency of the state on the grounds of ineligibility for the poll, reports The Guardian.

‎This followed an appeal filed by the candidate of the Peoples Democratic Party (PDP) ‎in the election challenging the tribunal ruling which cancelled the election and ordered the Independent National Electoral Commission (INEC) to conduct a fresh poll in the federal constituency.

Akinjo’s election had earlier been invalidated by the tribunal headed by Justice Antony Ogar, on October 6, 2015, based on the fact that he was not an eligible flagbearer of the PDP for the March 28 election.

The three-man panel led by Justice Abiyiri Shehu faulted the tribunal judgment for ruling that Akinjo was not a member of the PDP at the time of the election because his membership card was not signed by his ward chairman and secretary.

The court ruled that Akinjo’s challenger, Lucky Aiyedatiwa would have had a good case if he had presented another card to show that the federal lawmaker’s card was fake and not credible enough to attest to his membership of the PDP before the election.
